IMPORTANT: This End-User License Agreement ("EULA") is a legal agreement between you (the "End-User") and Raytoday LLC ("Developer"), not Apple Inc. ("Apple"). This EULA governs your use of the DjToday mobile application (the "Licensed Application").
The Developer, not Apple, is solely responsible for the Licensed Application and its content. Apple is not a party to this EULA and has no obligation with respect to the Licensed Application.
Subject to your compliance with this EULA, the Developer grants you a limited, non-transferable, non-exclusive license to:
License Restrictions: This license does not allow you to use the Licensed Application on any device you do not own or control, and you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time.
Developer's Responsibility: Raytoday LLC is solely responsible for providing any maintenance and support services for the Licensed Application. Support contact information is provided in Section 15 of this EULA.
Apple Has No Support Obligation: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
Developer's Warranty: Raytoday LLC warrants that the Licensed Application will substantially conform to its description and any applicable documentation for a period of ninety (90) days from the date of download.
Apple's Limited Role: In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application.
Developer's Full Warranty Responsibility: Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Raytoday LLC, to the extent not effectively disclaimed under applicable law.
You and Raytoday LLC acknowledge that Raytoday LLC, not Apple, is responsible for addressing any claims relating to the Licensed Application or your possession and/or use of it, including but not limited to:
This EULA does not limit Raytoday LLC's liability to you beyond what is permitted by applicable law.
You and Raytoday LLC acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, Raytoday LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim to the extent required by this EULA.
All intellectual property rights in and to the Licensed Application, including but not limited to copyrights, trademarks, trade secrets, and patents, are and shall remain the property of Raytoday LLC.
By using the Licensed Application, you represent and warrant that:
You must comply with applicable third-party terms of agreement when using the Licensed Application. For example:
Apple as Third-Party Beneficiary: You and Raytoday LLC acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
Pro Plan: $39.99 per month, billed monthly
Premium Plan: $69.99 per month, billed monthly
Free Trial: 60-day free trial available for new subscribers
Payment Processing: All payments are processed through Stripe, not through Apple's in-app purchase system. Subscriptions purchased through our website (djtoday.app) are not managed by Apple.
Automatic Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
Cancellation: You may cancel your subscription at any time through your account settings
No Refunds: Subscription fees are non-refundable except as required by law or as stated in Section 4 (Warranty)

The Licensed Application and all content, features, and functionality are owned by Raytoday LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
Your use of the Licensed Application is also governed by our Privacy Policy, which is available at djtoday.app/privacy-policy.html.

Your Rights: You may terminate this EULA at any time by deleting the Licensed Application and ceasing all use.
Our Rights: We may suspend or terminate your access to the Licensed Application if:
Effect of Termination: Upon termination, your right to use the Licensed Application ends immediately, and you must delete all copies from your devices.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RAYTODAY LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
Cap on Liability: In no event shall Raytoday LLC's total liability to you for all damages exceed the amount you have paid to Raytoday LLC in the twelve (12) months prior to the event giving rise to the liability.
You agree to defend, indemnify, and hold harmless Raytoday LLC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of this EULA or your use of the Licensed Application.
Governing Law: This EULA and any dispute arising out of or related to it shall be governed by and construed in accordance with the laws of the State of Texas and the United States, without regard to conflict of law principles.
Jurisdiction: You agree to submit to the personal jurisdiction of the state and federal courts located in Texas for the purpose of litigating all such disputes.
Arbitration: Any dispute arising from this EULA shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except for disputes that may be brought in small claims court.
We reserve the right to modify this EULA at any time. We will notify you of any changes by:
Your continued use of the Licensed Application after any changes constitutes your acceptance of the new EULA. If you do not agree to the modified EULA, you must stop using the Licensed Application.
If any provision of this EULA is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
This EULA, together with our Privacy Policy, constitutes the entire agreement between you and Raytoday LLC regarding the Licensed Application and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties.
